Prof. Brauneis highlights key facets of two cases integral to this question -- Bartz v. Anthropic and Kadrey v. Meta Platforms, Inc. In both cases, judges ruled in favor of AI developers, but these rulings have invited further questions regarding what exactly is considered “transformative” regarding AI training. Brauneis explains the four factors of fair use in the US and shares his opinion on the rulings from both cases.
